Terms of Service

These terms are the agreement between you and us about using Milapulse. We have tried to write them so they can be read in one sitting. Nothing in them takes away a right that the law gives you and that cannot be signed away, including under Kenya's Consumer Protection Act, 2012 and Data Protection Act, 2019, and, if you live in the EU, its consumer and data-protection law.
1. Who we are
Milapulse (milapulse.com, "the service") is a non-commercial hobby project for writing and games among family and friends, run by Dalipeer Networks (DPN) from Nairobi, Kenya ("we", "us"). Contact: legal@milapulse.com.
2. Milapulse is free
Milapulse costs nothing, shows no advertising, and makes no money from your data. If we ever introduce a paid feature, it will be optional, priced clearly before you choose it, and it will not take away anything you already have for free. We will never charge you without your explicit agreement at the time.
3. Your account
- You must be 18 or older.
- You join by invitation or through the sign-up page while it is open. New sign-ups are capped for now so the service grows at a pace we can look after.
- One person per account. Do not pretend to be someone else.
- Keep your password to yourself. Tell us at once at legal@milapulse.com if you think someone else has used your account.
4. What you publish is yours
- You keep every right to what you write and upload.
- You give us permission to store it and show it to the people you chose (your followers, or everyone if you make a post public), only to run the service. The permission ends when you delete the content or your account; backup copies are overwritten within 7 days.
- We do not sell your content, license it to others, or use it to train AI models.
- Only publish what you have the right to publish.
5. Rules for everyone
Do not use Milapulse to:
- publish anything unlawful, including defamation, hate speech, incitement to violence, or content that sexually exploits children;
- post pornographic or sexually explicit content;
- harass, threaten or bully anyone, or publish someone's private information without their consent;
- infringe copyright or other rights of others;
- send spam, malware, scams or advertising nobody asked for;
- break into, overload or disrupt the service, other accounts, or the systems they run on;
- scrape or bulk-collect other people's content or personal data.
The Arcade is for fun. Do not use it for betting or play for money.
6. Reporting content, and how we moderate
- Anyone can report content they believe breaks these rules or the law by writing to legal@milapulse.com with a link to it and the reason.
- People make moderation decisions here; no automated system removes content or suspends accounts.
- When something breaks these rules we may hide it, or suspend the account that posted it, at once. A suspended account is signed out, cannot sign in, and everything it published is hidden until the suspension is lifted.
- Sexual content involving a child is not simply deleted: we keep a copy and report it to the authorities. It is a crime under Kenya's Computer Misuse and Cybercrimes Act, 2018.
- If we hide your content or restrict your account, we tell you what we did, which rule it broke, and why, unless the law forbids us or telling you would put someone in danger.
- You can ask us to look again by replying to that notice. A person reviews the whole case again, including what you tell us, and we answer within one month. You can also go to a court or, where available, an out-of-court dispute body.
7. Leaving, and when we can close an account
- You can leave at any time: Delete my account in Settings deletes everything Milapulse holds at once, and your sign-in account within a few days. Before you go, Download my data there gives you a copy of it all, in a machine-readable form.
- We may suspend or close an account for a serious or repeated breach of these terms. Except where the content is plainly unlawful or sexual, there is an urgent risk of harm, or the law requires otherwise, we warn you first and give you a chance to respond, and you can take a copy of your content before the account closes.
- If your sign-in account is removed, your Milapulse account and everything in it are deleted too.
- If we ever shut Milapulse down, we give at least 60 days' notice and a way to export your content.
8. What we promise, and its limits
We will run Milapulse with reasonable care and skill, and fix what we get wrong. It is a free hobby project, so we cannot promise that it will always be available or free of faults, and features may change. What people publish is theirs, not ours; we do not endorse it.
We are not responsible for losses that were not foreseeable when you started using Milapulse, or that were not caused by our breach of these terms. This does not limit our responsibility for death or personal injury caused by our negligence, for fraud, for deliberate or grossly negligent harm, for breaking data-protection law, or for anything else that the law does not allow us to limit.
9. Changes to these terms
If we change these terms in a way that affects you, we tell you on the service and by email at least 30 days before the change takes effect, and say what changed. If you do not agree, you can leave before then and take your data with you. We will not make a change that applies to anything that happened before it took effect.
10. Disputes, and the law that applies
- Please tell us first; most problems can be fixed by talking.
- These terms are governed by the laws of Kenya, and the courts of Kenya can hear disputes about them.
- If you live in the EU, you also keep the protection of the mandatory consumer law of your country, and you can bring a claim in the courts where you live.
- There is no forced arbitration and no waiver of your right to join others in a claim. You can always complain to a regulator: about your data, to the Office of the Data Protection Commissioner in Kenya or your EU data-protection authority; about unfair treatment as a consumer, to the consumer-protection authority where you live.
